These Terms & Conditions ("Terms") govern your access to and use of the Hardscaper App website, applications, software, early-access programs, beta programs, and related products and services.
Hardscaper App products may include ProjectStory, FleetIQ, LeadScape, TimeSlate, and other products or services that reference these Terms.
"Hardscaper App,” “we,” “us,” and “our” refer to ConversoAI, doing business as Hardscaper App
"You" and "your" refer to the individual accessing the Services and, when applicable, the business or organization on whose behalf that individual is acting.
By creating an account, accessing or using the Services, purchasing a subscription, participating in a beta program, or otherwise accepting these Terms, you agree to be bound by them.
If you do not agree to these Terms, do not use the Services.
1. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services.
If you use Hardscaper App on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
In that situation, references to "you" include both you and the organization.
2. Hardscaper App Services
Hardscaper App provides software and technology tools designed primarily for businesses in the hardscape, landscape, construction, and related industries.
Different Hardscaper App products may provide different functionality, including tools relating to:
- Marketing and content creation
- Project documentation
- Photos, video, audio, and other media
- Fleet, vehicle, trailer, and equipment management
- Maintenance records and reminders
- Leads and customer relationship management
- Customer and vendor information
- Employee and crew timekeeping
- Business records and documents
- Artificial intelligence-assisted functionality
- Communications
- Other business-management functions
Features may be added, modified, removed, or replaced as the Services develop.
3. Accounts
Certain Services require an account.
You agree to provide accurate and current information and to maintain the accuracy of your account information.
You are responsible for:
- Protecting your login credentials
- Maintaining appropriate security for devices accessing your account
- Activities occurring through your account
- Promptly notifying us if you believe your account has been compromised
- Managing which employees, contractors, or other users are authorized to access your organization's account
You may not share credentials in a manner that circumvents account restrictions or permits unauthorized access.
4. Organization Accounts and Authorized Users
Businesses may authorize owners, managers, employees, contractors, or other personnel to use Hardscaper App.
The organization controlling the account is responsible for determining:
- Who may access the account
- What permissions each user should receive
- Whether users remain authorized
- Whether the organization has the right to provide information concerning its employees, customers, vendors, projects, or other individuals to Hardscaper App
Account administrators may be able to access, manage, modify, export, restrict, or delete information belonging to users associated with their organization.
If your access was provided by an organization, your use of the Services may be controlled by that organization.
5. Customer Content
"Customer Content" means information, files, media, and other material that you or your authorized users submit, upload, create, store, or process through the Services.
Customer Content may include:
- Photos and videos
- Audio recordings
- Documents
- Project information
- Customer information
- Employee information
- Equipment and vehicle records
- Maintenance information
- Leads and contact information
- Reviews and testimonials
- Business records
- Text and written instructions
- Prompts
- Branding information
- Other information submitted through the Services
As between you and Hardscaper App, you retain your rights in Customer Content.
You grant Hardscaper App a limited right to host, store, reproduce, process, transmit, modify, and otherwise use Customer Content only as reasonably necessary to provide, maintain, secure, support, and improve the Services and to perform actions you request.
6. Your Responsibility for Customer Content
You are responsible for Customer Content you provide to the Services.
You represent that you have the rights, permissions, licenses, and lawful authority necessary to provide and use that content.
This includes obtaining appropriate permissions when Customer Content contains or depicts:
- Customers
- Employees
- Subcontractors
- Property owners
- Jobsite visitors
- Testimonials or reviews
- Photos or videos belonging to another person
- Copyrighted material
- Personal information
- Other protected information or material
Hardscaper App does not independently verify that you have obtained every permission required for Customer Content.
7. Artificial Intelligence and Generated Content
Some Hardscaper App features may use artificial intelligence or other automated technologies.
These technologies may assist with activities such as:
- Generating marketing ideas
- Drafting written content
- Creating scripts
- Analyzing information
- Organizing content
- Processing images, audio, or video
- Producing or transforming media
- Making recommendations
- Summarizing information
AI-generated or automated output may contain errors, inaccuracies, omissions, or unexpected results.
You are responsible for reviewing generated content before relying on, publishing, distributing, or using it.
Hardscaper App does not guarantee that AI-generated content:
- Is accurate
- Is complete
- Is unique
- Is free from third-party rights
- Is suitable for a specific purpose
- Can receive copyright or other intellectual-property protection
- Complies with every law, regulation, contract, industry standard, or advertising requirement
You remain responsible for claims, representations, advertisements, communications, and other content you choose to publish or distribute.
8. Photos, Testimonials, Reviews, and Marketing Content
Hardscaper App may allow businesses to create marketing materials using project photos, customer experiences, reviews, testimonials, or other content.
You are responsible for obtaining any permissions or releases required before using a person's:
- Name
- Image
- Voice
- Testimonial
- Review
- Property
- Project
- Business information
- Other protected material
The fact that Hardscaper App technically allows content to be uploaded or generated does not mean that you automatically have legal permission to publish that content.
9. Fleet and Equipment Information
FleetIQ and other Hardscaper App functionality may provide reminders, records, schedules, recommendations, or organizational tools relating to vehicles, trailers, tools, machinery, and equipment.
These features are informational and organizational tools.
Hardscaper App is not a substitute for:
Manufacturer maintenance requirements
- Equipment manuals
- Professional mechanical inspection
- Qualified technicians
- Required safety inspections
- Applicable laws and regulations
- Proper equipment operation
- Workplace safety procedures
You remain responsible for determining whether any vehicle or piece of equipment is safe to operate.
A missing reminder, incorrect record, delayed notification, software error, or other issue with the Services must never be treated as confirmation that equipment is safe.
10. Timekeeping and Employment Information
TimeSlate and other Hardscaper App functionality may assist businesses in tracking employee or crew work time.
Hardscaper App provides recordkeeping tools and does not provide legal, payroll, tax, accounting, or human-resources advice.
Employers remain responsible for determining and complying with applicable requirements concerning:
- Wages
- Overtime
- Meal and rest periods
- Recordkeeping
- Payroll
- Employee classification
- Timekeeping
- Labor and employment laws
You should review time records before using them for payroll or other legally significant purposes.
11. CRM, Leads, Customers, and Communications
LeadScape and other Hardscaper App functionality may help organize leads, customers, vendors, communications, and business relationships.
You are responsible for ensuring that your use of contact information and communications complies with applicable laws and that you have any consent required to contact individuals.
Hardscaper App does not guarantee:
- Lead quality
- Sales
- Revenue
- Customer conversion
- Marketing results
- Response rates
- Business outcomes
12. Early Access and Beta Services
Certain Hardscaper App products or features may be offered as early-access, preview, prototype, test, or beta services.
Beta Services may:
- Contain bugs
- Operate incorrectly
- Be unavailable
- Change significantly
- Lose or corrupt data
- Have incomplete features
- Be discontinued
- Perform differently from a future commercial release
You should not rely exclusively on Beta Services for critical business operations.
We may modify or discontinue Beta Services at any time.
Participation in a beta program does not guarantee that a feature or product will become commercially available.
13. Feedback
If you provide suggestions, ideas, bug reports, recommendations, feature requests, or other feedback regarding Hardscaper App, you grant us permission to use that feedback without restriction or compensation to improve, develop, market, or operate our products and services.
This does not transfer ownership of your Customer Content to Hardscaper App.
14. Subscriptions and Fees
Certain Services may require payment.
Pricing, billing frequency, included features, usage limitations, and other subscription details will be presented when you purchase or subscribe to a Service.
You agree to pay applicable fees and taxes associated with your subscription.
Subscription pricing may change from time to time. Any price changes will apply prospectively and will be communicated where required.
If a subscription automatically renews, the renewal terms will be disclosed when you subscribe.
You may cancel a subscription using the cancellation methods made available for the applicable Service.
Cancellation stops future renewal but does not necessarily provide a refund for amounts already paid unless otherwise stated or required by law.
15. Free Trials and Promotional Access
Hardscaper App may offer free trials, promotional access, credits, or limited free usage.
The specific terms presented when the trial or promotion is offered control that offer.
A free trial does not automatically create an entitlement to continued free service.
If payment information is required for a particular trial or if a trial will convert into a paid subscription, that information will be disclosed before enrollment.
16. Taxes
Fees displayed for Hardscaper App may not include taxes.
You are responsible for applicable sales, use, excise, value-added, or similar taxes associated with your purchase, except taxes based on Hardscaper App's income.
17. SMS and Text Messaging Terms
If you voluntarily provide your mobile telephone number and separately consent to receive text messages from Hardscaper App, we may send SMS or MMS messages relating to Hardscaper App products and services.
Messages may include:
- Early-access information
- Beta-testing information
- Product announcements
- Requested information
- Account or service communications
- Customer-support communications
- Reminders or notifications
- Marketing or promotional communications when you have consented to receive them
- Message frequency varies.
- Message and data rates may apply.
- Consent to receive marketing text messages is not a condition of purchasing
- Hardscaper App products or services.
You may opt out of SMS communications at any time by replying STOP to a message.
After opting out, you may receive a confirmation that your request has been processed.

18. Email Communications
You may receive transactional or administrative emails relating to your account or use of the Services.
If you choose to receive marketing emails, you may unsubscribe using the unsubscribe mechanism provided in those communications.
Unsubscribing from marketing communications does not prevent us from sending necessary account, security, billing, or service communications.
19. Acceptable Use
You may not use Hardscaper App to:
- Violate applicable law
- Infringe intellectual-property rights
- Upload material you do not have authority to use
- Harass, threaten, defraud, or impersonate another person
- Distribute malware or harmful code
- Attempt unauthorized access to systems or accounts
- Circumvent security controls
- Interfere with the operation of the Services
- Use automated systems to scrape or extract data without authorization
- Reverse engineer or attempt to discover source code except where applicable law expressly permits it
- Use the Services to facilitate spam or unlawful communications
- Use the Services for fraudulent, deceptive, or abusive activity
- Resell or commercially exploit the Services except where expressly authorized
We may investigate suspected violations and restrict or suspend access where reasonably necessary to protect Hardscaper App, customers, users, or third parties.
20. Hardscaper App Intellectual Property
Except for Customer Content and third-party materials, Hardscaper App and its licensors own the Services and associated intellectual property.
This includes, as applicable:
- Software
- Source code
- Innterfaces
- Designs
- Branding
- Logos
- Documentation
- Workflows
- Databases
- Technology
- Content created by Hardscaper App
- Product names and marks
Your subscription or account gives you a limited right to use the Services. It does not transfer ownership of Hardscaper App intellectual property to you.
21. Limited License
Subject to these Terms and payment of applicable fees, Hardscaper App grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business purposes.
You may not copy, sublicense, sell, lease, distribute, or commercially exploit the Services except as expressly permitted by Hardscaper App.
22. Third-Party Services
Hardscaper App may integrate with or rely upon third-party services.
These may include services for:
- Hosting
- Data storage
- Authentication
- Artificial intelligence
- Communications
- Payment processing
- Analytics
- Media processing
- SMS
- Other technology infrastructure
Third-party services may experience interruptions, changes, errors, or outages outside Hardscaper App's control.
Your use of certain third-party services may also be governed by those providers' terms.
23. Availability and Changes to the Services
We work to provide reliable Services, but we do not guarantee uninterrupted or error-free availability.
We may:
- Perform maintenance
- Modify features
- Add features
- Remove features
- Change technical requirements
- Restrict access for security reasons
- Discontinue products or functionality
Where reasonably practical, we will attempt to provide notice before material changes that significantly affect paid Services.
24. Data Backup and Export
Hardscaper App may provide storage, backup, or export features depending on the applicable product.
You are responsible for maintaining copies of information that is critical to your business.
Hardscaper App should not be treated as the sole permanent repository for information that you are legally or operationally required to retain unless the applicable Service expressly states otherwise.
25. Suspension and Termination
You may stop using the Services at any time.
We may suspend or terminate access when reasonably necessary because of:
- Violation of these Terms
- Nonpayment
- Fraud
- Abuse
- Security risk
- Illegal activity
- Risk of harm to Hardscaper App or others
- Legal requirements
- Material misuse of the Services
Where appropriate, we may provide an opportunity to correct a violation before termination.
Certain provisions of these Terms will continue after termination where their nature requires them to survive.
26. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
HARDSCAPER APP DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTIES THAT MAY OTHERWISE ARISE BY LAW, COURSE OF DEALING, OR USAGE OF TRADE.
WE DO NOT WARRANT THAT:
- THE SERVICES WILL ALWAYS BE AVAILABLE
- THE SERVICES WILL BE ERROR-FREE
- ALL DATA WILL ALWAYS BE PRESERVED
- AI-GENERATED OUTPUT WILL BE ACCURATE
- REMINDERS OR NOTIFICATIONS WILL ALWAYS BE DELIVERED
- THE SERVICES WILL PRODUCE A PARTICULAR BUSINESS RESULT
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
27. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HARDSCAPER APP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
TO THE FULLEST EXTENT PERMITTED BY LAW, HARDSCAPER APP'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
THE AMOUNT YOU PAID TO HARDSCAPER APP FOR THE APPLICABLE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
$100 IF YOU HAVE NOT PAID HARDSCAPER APP FOR THE SERVICE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
28. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Hardscaper App and its owners, officers, employees, contractors, and affiliates from claims, damages, liabilities, losses, and reasonable costs arising from:
- Your misuse of the Services
- Customer Content you provide
- Your violation of these Terms
- Your violation of applicable law
- Your violation of another person's rights
- Communications or marketing conducted using the Services
- Your failure to obtain required permissions or consents
This obligation does not apply to the extent a claim results directly from Hardscaper App's own unlawful conduct.
29. Privacy
Our collection and use of personal information is described in the Hardscaper App Privacy Policy:

The Privacy Policy is incorporated into these Terms by reference where permitted by law.
30. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles.
Any dispute arising from these Terms or the Services will be brought in the appropriate state or federal courts located in Lake County, Illinois, unless applicable law requires otherwise.
31. Changes to These Terms
We may update these Terms as Hardscaper App and its Services develop.
Updated Terms will include a revised "Last Updated" date.
Material changes will apply prospectively, and we will provide additional notice when reasonably appropriate or legally required.
If you continue using the Services after updated Terms become effective, your continued use may constitute acceptance of the updated Terms where permitted by law.
32. Assignment
You may not assign these Terms without our prior written consent.
Hardscaper App may assign these Terms in connection with a merger, acquisition, corporate reorganization, financing, sale of assets, or similar business transaction.
33. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
34. No Waiver
Failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
35. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented for a particular Service or subscription, constitute the agreement between you and Hardscaper App concerning the Services unless a separate written agreement applies.
